Pro-Palestinian NGO Seeks ICC Arrest Warrant for Israel’s Foreign Minister

 

A pro-Palestinian organization, the Hind Rajab Foundation (HRF), has officially filed a complaint with the International Criminal Court (ICC) seeking an arrest warrant for Israeli Foreign Minister Gideon Sa’ar. The group alleges that Sa’ar is responsible for war crimes and crimes against humanity amid Israel’s ongoing military operations in Gaza since October 7, 2023.

The timing of the complaint coincides with Sa’ar’s planned visit to Brussels next week. Despite the legal action, his office has confirmed that he intends to proceed with the visit as scheduled. While neither Israel nor the United States recognizes the ICC, Belgium, as a signatory to the Rome Statute, is legally obligated to cooperate with the court.

HRF emphasized that Belgium must uphold international justice by ensuring Sa’ar does not evade accountability while on European soil. The organization argues that permitting a suspected war criminal to visit Brussels unchallenged would undermine international legal commitments and the principles of justice.

HRF, which describes itself as an advocate against Israeli impunity, is named after Hind Rajab, a five-year-old Palestinian girl who was reportedly killed by Israeli tank fire while trapped in her family’s car in Gaza. The group asserts that Sa’ar played a significant role in shaping and implementing policies that have led to mass displacement, collective punishment, and targeted attacks on Palestinian civilians.

According to HRF, Sa’ar’s public statements and policy decisions indicate direct or indirect involvement in these alleged crimes, as well as efforts to obstruct international justice. The group specifically cites his advocacy for reducing Gaza’s territorial boundaries and endorsing a total blockade, restricting essential resources such as food, water, and medical aid.

Furthermore, HRF argues that Sa’ar shares responsibility with Israeli Prime Minister Benjamin Netanyahu’s administration, pointing out that the ICC previously issued an arrest warrant for Netanyahu and former Defense Minister Yoav Gallant in November of the previous year.

This is not the first legal action initiated by HRF. The organization has actively pursued legal cases against Israeli military personnel suspected of war crimes. In a notable instance, HRF filed a lawsuit against a former Israeli soldier vacationing in Brazil, accusing him of involvement in war crimes during his service in Gaza. A Brazilian judge ordered an investigation into the allegations, but the soldier left the country before any action could be taken.

HRF has been tracking the movements of numerous Israeli soldiers linked to military operations in Gaza, seeking legal accountability through international judicial systems. This campaign has prompted the Israeli foreign ministry to caution its citizens against sharing military-related content on social media, warning that such information could be used to initiate legal proceedings against them.

As the ICC evaluates the complaint, the outcome could set a precedent for international legal actions against high-ranking officials involved in armed conflicts. The case highlights the growing efforts by human rights organizations to hold global leaders accountable for alleged war crimes, further intensifying the geopolitical tensions surrounding the Israel-Palestine conflict.
